Please read these Terms and Conditions carefully before using the "The Cartoon Studio" web site. Your access to and use of the web site is subject exclusively and strictly to these Terms and Conditions. By using the web site you agree to be bound by these Terms and Conditions. If you place an order for a cartoon, your purchase will be subject to our terms of sale.

We may:

1. change or remove (temporarily or permanently) the web site (or any part of it) without notice to you at any time; and
2. change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the web site. If you do not agree with any change to the Terms & Conditions you should not continue to use the web site.

You should also review our privacy policy and view information on how we create your cartoon. We have also compiled a list of frequently asked questions (FAQs) which you may find useful.

Terms of Sale (Digital Services)

All prices quoted on "The Cartoon Studio" are inclusive of VAT @ 17.5%. No delivery charges apply to online sales as delivery is via our secure online customer area.

In accordance with the UK E-Commerce Regulations 2002 we provide the following:

• Orders can be amended by going back a step before the order is placed
• We acknowledge receipt of your order immediately via e-mail

1.0 - Delivery

1.1 - We aim to deliver your cartoon within 30 days from the date your payment has cleared or the date we have received your photo (whichever comes last). If we cannot deliver your cartoon by this date you will be notified prior to this date. You will then be entitled to a full refund. If you receive delivery of your cartoon prior to cancellation and after this 30 day period you will no longer be entitled to a refund.

1.2 - Delivery of your cartoon will take the form of a digital download and not a physical product. We supply you with a JPEG and an Adobe PDF document. More detailed specifications of these documents is shown below:

• JPEG - 300dpi, 14"x12"/30.5cm x 35.6cm/4200px x 3600px
• Adobe PDF

These documents will be downloadable from our secure customer area. You will be given a password to access this area when placing your order. You will be notified by e-mail once your cartoon is ready to download.

1.3 - Before placing your order please make sure your computer has the capabilities to download your cartoon. We cannot take any responsibility for problems when downloading your cartoon, unless it's the fault of The Cartoon Studio. We can in severe circumstances deliver your cartoon via e-mail of CD-ROM. A small fee will be required in these circumstances.

2.0 - Your Order

2.1 - Orders are placed online using our simple 4 step wizard. The 4 steps are as follows:

1. Your Details
2. Your Cartoon
3. Your Photo
4. Payment

We require some basic customer details, including name, e-mail address, and contact telephone number. You must tell us as much information about your cartoon including the style, background, text, colour and any additional information. You can then choose to upload your photo using our online upload facility or send it via e-mail, after you have placed your order.

Payment can be made via our secure payment service using a major credit/debit card, or via personal cheque (UK Only), bankers draft (UK Only), or postal order (UK Only). If you choose not to pay online using a credit/debit card your order will only be processed once your payment has cleared.

Once you have placed your order and told us as much information you can about your cartoon you will be notified via e-mail to the e-mail address you supplied when ordering. This e-mail will contain your order details including your order reference number and password (to access our secure customer area).

From our secure customer area you can amend your order details. We regret that your order cannot be amended once our design team have started work on your cartoon. This is typically 5 days after your payment has cleared or your photo has been received (which ever comes last).

2.2 - We cannot take responsibility for anything which you failed to mention at the time of ordering. We create your cartoon to the best of our abilities and using the information you provide when ordering. We provide you with plenty of opportunity to state detailed information on how you would like your cartoon when ordering. We provide 5 large individual fields for additional details regarding your order. If you fail to mention something when ordering you cannot use this as a basis for complaint. We are unable to illustrate items which do not appear in the photo, unless details are given when ordering. For example, if the photo is of a persons head and shoulders, we will draw a cartoon based on this. If you would like your head to appear on your body please let us know when ordering. This does not apply to all styles of cartoon.

If you feel your cartoon has not been drawn to your satisfaction please contact The Cartoon Studio on immediately and we will investigate the issue.

3.0 - Cancellations

3.1 - We offer a 7 day cancellation policy with a full refund (this is known as a "cooling off period"). The 7 days commence from the date ordered.

To cancel your order please do so in writing to or via our contact form in our secure customer area.

Unfortunately we cannot offer refunds on cancellations after this "cooling off period", unless the 30 days has expired (as stipulated in section 1.1).

In certain special circumstances The Cartoon Studio may be able to offer a part refund after this period. This will be up to the discretion of The Cartoon Studio and providing your order has not been passed to our design team.

4.0 - Refunds

4.1 - As the cartoons are personalised digital products designed to the customers specifications we regret that we are unable to offer refunds on all orders. We do offer a 7 day cancellation/refund policy as described in section 3.1.

We also offer a refund policy on orders which have not been fulfilled within 30 days from the date the order was complete. More information is shown in section 1.1.

If you are not satisfied with your cartoon please contact us immediately. Minor modifications can generally be made, although additional charges may be incurred.

5.0 - Acceptance

5.1 - Once an order has been placed The Cartoon Studio process the order to make sure all the necessary details are present. The acceptance of an order is to the discretion of The Cartoon Studio and we reserve the right to not accept an order. In these exceptional circumstances you will be given a full refund and a full explanation will be given.

The Cartoon Studio retains copyright over all images, however, with the exception of commercial use, you are able to use and reprint the image as you wish. The Cartoon Studio also reserves the right to use a small version of any cartoon on The Cartoon Studio web site. If you specifically do not wish for your cartoon to be used as a sample, please contact us.

Commercial Use

If you intend to use cartoons for commercial use, please contact us. Depending on the use, additional fees may apply.

Limitation of Liability

1. The web site is provided to you on an "as is" and "as available" basis without any warranty being given in relation to the web site including (but not limited to) implied warranties of compatibility, security, accuracy or any implied warranty arising from course of dealing or usage.
2. No warranty is provided by us that the web site will meet your requirements or will be uninterrupted, timely, or error-free, that defects will be corrected or that the web site or the server(s) that makes it available are free of viruses or bugs.
3. We will not be responsible or liable to you for any loss of material uploaded or transmitted through the web site.
4. To the fullest extent allowed by applicable law we will not be liable to you or any third party for any economic loss (including without limitation loss of revenues, profits, contracts, business or anticipated savings), or any consequential, special or indirect losses whatsoever that arise out of or are related to this web site.
5. Nothing in this paragraph applies to our liability in respect of goods and/or services sold through this web site.
6. Nothing in these Terms & Conditions shall exclude or limit liability for death or personal injury resulting from our negligence.
7. We try our utmost best to make sure that any e-mails or files are virus, worms, trojan horse, and spy ware free. We cannot take responsibility for any viruses, worms, torjan horses, or spy ware received as a result of The Cartoon Studio.

Outside of the UK

If you are based outside of the United Kingdom.

1. Because laws and regulations differ from country to country, we make no warranties, express or implied that making the web site available in any particular jurisdiction outside of the United Kingdom is permitted under any applicable non-UK laws or regulations. Accordingly, if making the web site available in your jurisdiction or to you (by reason of nationality, residence or otherwise) is prohibited, this web site is not offered to you.
2. You accept that if you are resident outside of the United Kingdom, you must satisfy yourself that you are lawfully able to use the web site.
